These Terms and Conditions apply to all purchases of Goods which are sold by Nourishica. By placing an order on this website you agree to abide by these Terms and Conditions.

We reserve the right to change these Terms and Conditions at any time. Any such changes will take effect when posted on the website and it is your responsibility to read the Terms and Conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest Terms and Conditions.

In these Terms and Conditions (the “Conditions”) the following words shall have their corresponding meaning:

“Buyer” or “you” refers to the person(s), firm or company who purchases the Goods from the Company.

“Company” Nourishica

“Goods” any Goods agreed to be supplied to the Buyer by the Company (including any part or parts of them).

"Delivery Date" the date on which the Goods are to be delivered as stipulated in the Buyer's order and accepted by the Seller.

“Contract” any agreement between the Company and the Buyer for the sale and purchase of the Goods, incorporating these Conditions.

  • We exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) to the maximum extent permitted by applicable law.

  • We will not be liable for direct, indirect or consequential loss or damage arising under these terms and conditions, whether arising in tort, contract, or otherwise, including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.

  • We will not be held responsible for any loss suffered by the use of any products purchased by customers containing ingredients prohibited by a sports governing authority or by a relevant anti-doping agency. We encourage any customer participating in a sport to check any rules and regulations regarding the use of any supplements before purchasing any product.

  • We will not be liable for any medical defects, ailments or illness suffered by the customer from the use of any products. All customers purchase products with full knowledge of their ability to consume them. If there is any doubt of a customer’s ability to use any products, we encourage the customer to seek professional medical advice.

  • We will not be liable for any claims made by any product.

  • We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website.

  • We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time. If the delay occurs before the products are dispatched, we will not charge you for the products until they are dispatched, and you may cancel your order at any time prior to dispatch.

  • The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all the above limitations may not apply to you and you might have additional rights.

  • Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

Returns and Refunds

We appreciate that at times it may be difficult to purchase a product over the Internet, especially when you can only see a picture and description of a product. Should you wish to return purchased goods back to us, we will be happy to refund or exchange them provided they are totally unused and in a fully resalable condition within 30 days of purchase.

How to Return Goods bought On-line:

We will advise you whether to return the goods to ourselves directly or the manufacturer depending upon the problem. We accept the return of goods sent back to us if you follow the below conditions. We will refund you any money which you have paid us for the item or offer you an alternative product of similar value as a replacement if required, If the similar product is cheaper, we will automatically refund you the difference. The only costs you incur is the return postage of the unwanted goods and our postage costs we incurred for sending the goods to you. We do not, however, accept the return of opened and/or part used goods.

  1. If you want to refund an unwanted item, please make sure you notify us within 14 days from the date you received the item, this is also known as a cooling off period.

  2. From the date you notified us regarding the cancellation you then have another 14 days to get the item back to us.

  3. If you return your purchase by post or courier after the periods outlined above (with the exception of faulty or damaged goods), we reserve the right not to offer you a refund in full. We may instead return your purchase to you. Prior to sending, the cost of re-delivering the item will be at your own expense.

  4. No refund or exchange will be given without a receipt, dispatch note or other proof of purchase.

  5. Refunds can only be given for products which are returned to us in their original condition. We cannot issue a refund for any item which has been opened or used.

  6. Photo evidence will be needed for all damaged items that need to be returned.

  7. Any item sent back to us over the outlined time frames will not be refunded, it will be your own responsibility for re-delivery or collection of the item.

  8. We will refund you within 14 days of receiving the item back.

  9. Refunds will be paid to the original payment method.

If an item bought online turns out to be faulty, then you are protected by the same rights that apply to purchases made in person. We will reimburse you for the cost of sending the item back to us. We will need to see the cost of the delivery receipt to reimburse you for the returned item.

If you have an item that was faulty or damaged at the time of sale, it needs to be returned to us within 30 days for a refund.

We suggest you use a carrier which offers recorded delivery to ensure that if it does not arrive with us you can put in a claim through the courier as the goods are not our responsibility until we receive the item back. Please use sufficient packaging to ensure the contents are not damaged in transit.

If an order is returned to us because no one has been at the shipping address invoice to receive the item and no other arrangement has been made between the customer and the courier, the returned item will be refunded minus the amount the item cost us to send out to you, plus an additional charge the courier has charged us for returning the item back to us.

If an order is returned to us because you have entered incorrect/missing address information on the sales invoice and the carrier isn't able to locate your address the returned item will be refunded minus the amount the item cost us to send out to you plus the additional charge the courier has charged us for returning the item back to us.

If the customer has refused delivery (with no mistake on our part) and the item is returned to us, the returned item will be refunded minus the amount the item cost us to send out to you plus the charge the courier has charged us for returning the item back to us. Refusal of correct deliveries is deemed to be breaking our terms and conditions unless there is a mistake with the order, or the order has been damaged in transit.

Products that Cannot be Returned:

The following items cannot be returned within the terms of our refund policy:

  • Gift Cards

  • Frozen or perishable goods

  • Samples or free items

Changes to Your Order

You have a right to cancel your order and receive a full refund prior to goods being dispatched. To cancel an order before the item is dispatched it is FREE, once the item has been dispatched, delivery & redelivery charges will be deducted from the original cost paid, you are advised to contact us first on site contact form, then second option if the first option is unsuccessful would be to email us at team@nourishica.com

  • In respect of non-perishable items, you have the right to return goods within 14 days of receipt of your goods in perfect condition, unused and in their original packaging. We ask that items are returned to us with their original packaging and with any tags intact. You must also contact our customer support team to notify us prior to returning the items.

  • In the case of items which include a hygiene or security seal, we ask that you exercise reasonable care by not removing the seals while examining the goods, unless you are certain that you intend to keep the goods. If any seals or tags are removed or tampered with, we shall not permit that item to be returned nor shall we refund the cost of this item to you.

  • We will arrange with you for canceled non—perishable goods to be returned to us, and we will credit your payment card with the price of such goods within 14 days from the date you returned the goods to us (provided payment has already been debited to your payment card).

  • The cost of postage, packaging and the insurance relating to the return of unwanted goods back to our warehouse are fully the responsibility of the customer; furthermore the postage cost of the original consignment of the goods will be deducted from any refunds.

Offers and Promotions

From time to time, and in our complete discretion, purchases of goods may be subject to special offers. In the event that such a special offer applies to your purchase, the terms of such special offer shall be subject to these Terms & Conditions. If there is any conflict between the terms of a special offer and these Terms & Conditions, these Terms & Conditions shall prevail unless specifically excluded.

  • We may change the terms of special offers, or withdraw them altogether, at any time and without prior notice.

  • We will honor at the offer price any order placed by you before an offer ends, or is amended, withdrawn with the exception of allocated stock shortage for the specific offer.

  • We reserve the right to offer in our complete discretion different customers different special offers and promotions.

Complaints Procedure

We aim to deal with all complaints effectively. For a speedy response complaint may be submitted via our online utility, or alternatively mailed to the registered head-office.

We aim to acknowledge by email any emailed or mailed complaint within 5 working days, and to conclude our investigations as soon as possible thereafter. Telephone complaints will not necessarily be acknowledged by email prior to investigation. A likely timescale for resolution will be provided upon request, but this timescale will be dependent upon the specific nature of the complaint.

Cancellation of Orders and Suspension of your Member Account

We reserve the right to cancel your delivery at any time if we suspect fraud, have reason to believe you are in breach of these Terms and Conditions or any other terms and conditions relating to your order, or if there is an outstanding payment for any order or service. For example, if you are in breach of our terms and conditions relating to discount offers and vouchers, we may cancel your order. In the event that we cancel your order, you will receive email notification and will be invited to contact our call customer support team.

In addition to our right to cancel your order, we reserve the right to suspend your account. Your account will remain suspended until you contact our customer support team and remedy any breaches which are capable of remedy, or provide any information reasonably requested by our call center advisers to enable them to reactivate your account.

In the rare event that unforeseen operational or technical issues occur, we may need to cancel or rearrange delivery. If this happens, we will endeavor to contact you to arrange an alternative delivery date.

Methods of Payment

Currently, you have the option to make purchases using the widely accepted payment systems: Visa, Mastercard, PayPal, and Apple Pay. If you don't have Visa, Mastercard, PayPal, or Apple Pay, you can place your order directly through our contact form.

Out-of-Stock Items

If any item you have chosen is unavailable, we will contact you via your e-mail address or via phone within 3 working days from receiving your order.

Website Availability

We do not guarantee that our site or its content will always be available, nor do we guarantee that we will provide an error free service. We may suspend our service for operational reasons such as repair, maintenance or improvements, or otherwise in emergencies and we may change or discontinue the availability of any content, goods or services at any time as we see fit.

Delivery

We will endeavor to despatch goods as promptly as possible; this is usually 7—10 days.

Delivery time frame (and the cost if any) specific to your order is quoted within the order confirmation page once you submit your delivery location. This is due to the fact that we can only calculate the estimated delivery to you once we know your delivery location.

  • We undertake to inform you of any subsequent change to the delivery time within 48 hours of receiving your order.

  • Couriers and delivery services we use tend to deliver during the working day. You may find it easier to give a work address if it is unlikely that anyone will be in to sign for your order.

  • For heavy or bulky items we reserve the right to charge a redelivery fee if the customer is not there to collect the goods as arranged.

  • Standard delivery is between 9am and 6.30pm. Saturday deliveries may be available on certain products.

  • If access for delivery is restricted, please ensure that you inform us prior to delivery. Failure to do so may result in an additional shipping charge. Examples include gravel pathway, 2nd floor without a lift.

  • Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or canceled delivery. If that is the case, we will endeavor to contact you as soon as we are able to in order to reschedule your delivery time and date. In any event, our liability to you will be limited to the price of goods not delivered and the cost of delivery.

Signing for Goods

Upon delivery of goods please check them carefully for signs of possible damage before you sign to say that you have received them in good condition. It is not always possible to determine if the internal contents have been damaged and we strongly advise you to cross out the word ‘Received in good condition’ and write ‘Damaged’ before you sign, or to write ‘Damaged' above your signature. This is to ensure that, if necessary, a claim can be made against the courier company.

Unfortunately, our carriers accept no other wording and it is extremely difficult for us to claim that your goods were damaged in transit if you have previously signed to declare that you received your order in good condition.

If you receive a parcel, which is obviously damaged beyond all levels of acceptability, you must REFUSE the delivery. Do not sign for the items, then contact us immediately stating the reason for refusal. We will then resolve the problem in the best and quickest means possible. Fortunately, this happens very rarely.   

Please note:

All delivery time estimates are subject to stock availability and receiving your order by 4:00 pm the day you made the transaction. Orders placed after 4:00 pm on the day of transaction will be processed next working day. Orders are not processed or delivered on weekends and bank holidays. Furthermore, due to the volume of parcels around bank holidays, in particular, Christmas, parcels may be delayed by our couriers. For example, if you completed your transaction on Friday at 5:00pm asking for Next Day Delivery your items will not be packed until Monday and your items should be delivered on Tuesday.

If for any reason we expect that your order will not arrive within the specified times, we will email or call you shortly after receiving your order. It is therefore particularly important for you to provide a valid e-mail address and contact number that we can get hold of you on. Please be sure to check your emails and phone messages shortly after placing the order in case we need to contact you.

We accept that unfortunately there may sometimes be occasions when, for any reason, there is a problem with delivery. It may arrive late; it may arrive damaged; it may not arrive at all. In any of these cases, we will endeavor to ensure that a replacement is arranged with the absolute minimum of fuss for you, and that you get a full refund for any postage you have paid. Incorrect delivery information as stated by the customer is the responsibility of the customer, who will be liable for any re-delivery or return charges.

Lost Parcels:

We insure all of our parcels, in the event of your parcel going missing we will take full responsibility in refunding or replacing your item at no additional cost as long the claim is not fraudulent. Claims can be made 7 working days from the date the item was supposed to be delivered.

Parcels Damaged in Transit:
